Axians Data Protection and Privacy Policy
This Personal Data Protection and Privacy Policy (“Privacy Policy”) provides information on how Vinci Group Companies process the Personal Data of users who browse the website www.axians.pt or other websites belonging to the Vinci Group (“Website”) in accordance with applicable legislation on personal data protection and privacy.
A) Data Controller
AXIANS PORTUGAL, headquartered at Av. Dom João II 44 C Piso 5, 1990-095 Lisbon (hereinafter referred to as “AXIANS”), individually or jointly with other Vinci Group Companies, are responsible for the processing of your personal data for the purposes indicated in this Privacy Policy.
B) Personal Data, Processing of Personal Data, and Data Subject
Personal Data is all information and/or elements that, regardless of their support, can, as a natural person, identify you or make you identifiable, directly or indirectly, before AXIANS, in particular by reference to an identifier, such as a name, an identification number, your location data and/or identifiers by electronic means or to one or more specific elements of your physical, physiological, genetic, mental, economic, cultural or social identity.
Processing Personal Data means the operation or set of operations performed on Personal Data of Data Subjects, through automated or non-automated means, from the collection of information to its destruction. Within this cycle, among others, include registration, organization, structuring, storage, adaptation or alteration, recovery, consultation, use, disclosure by transmission, dissemination or any other form of provision, comparison or interconnection, limitation, erasure.
Users of the Website will be qualified as Data Subjects, without limitation, investors, customers and potential customers, suppliers, employees, and candidates for employees, members of corporate bodies, participants, visitors, or any other third parties who browse the Website to take advantage of its various purposes.
C) Personal Data we collect, for what Purposes and Legal Grounds
The functionalities made available on the Website mean that Personal Data is processed for specific, explicit purposes by AXIANS. In some cases, you will not be required to share your Personal Data, but if you choose not to share, AXIANS may not be able to provide the services or products you require, ensure certain specialized functionalities, or respond effectively to any questions you may have.
Website Management
When you visit our Website, without providing us with additional information through our forms, we process your Personal Data such as your electronic identifier, connection start date/time, connection end date/time, the origin of web browsing, URL visited, social network address, or hostname. Without this Personal Data, we are unable to communicate with the browser and display our Website on your device. This Personal Data is processed based on the execution of the contract whose terms are governed by the Terms and Conditions available on the Website.
Contact Management
We collect your Personal Data, such as your name, contact details, and email address, when you contact us through the Website and we use them to respond to your questions, complaints, or any other matter you wish to clarify with AXIANS. The processing of your Personal Data is based on your unequivocal consent when you submit the form and contact us.
Recruitment and Selection
On the Website we may also collect your Personal Data when you submit a spontaneous application form for our analysis or wish to apply for an internal Selection and Recruitment process promoted by AXIANS. We may process your Personal Data such as the application date, interview results, admission test/exam results, curriculum vitae, or qualification certificate, Personal Data that we process based on your consent when submitting the application form.
In cases where you apply for an internal Selection and Recruitment process promoted by AXIANS and are not selected, we may continue to process your personal data in a compatible manner, for the purposes of the remaining internal Selection and Recruitment processes and/or for opportunities that may arise.
Commercial Activity and Marketing
Your Personal Data may also be processed in the context of our commercial and marketing activity when you subscribe to our newsletter to receive information about our products or services. For this purpose, we may collect your telephone/mobile number, email address, date/time of contact, place of origin of the contact or preferred contact, Personal Data that will be processed based on your express consent.
D) Sharing your Personal Data
Entities providing services to AXIANS (“Subcontractors”):
Your personal data may be provided to companies responsible for providing services to AXIANS under a written contract that binds the Subcontractors to only process your Personal Data for the purposes set out in this Privacy Policy and are not authorized to process them, directly or indirectly, for any other purpose, for their own benefit or that of a third party.
Other “Controllers” or “Third Parties” with whom AXIANS may share your Personal Data:
If there is a legitimate interest in sharing your Personal Data within the group, AXIANS may transmit your Personal Data to other companies in the Vinci Group for internal administrative purposes and guarantee that they will process your Personal Data in accordance with this Privacy Policy.
At your request and with your consent, your Personal Data may also be shared with other entities with which AXIANS may not have a direct commercial relationship.
In compliance with legal and/or contractual obligations, Personal Data may also be transmitted to judicial, administrative, supervisory, or regulatory authorities and also to entities that lawfully carry out data compilation actions, fraud prevention, and combat actions, market or statistical studies in an anonymous form.

We provide hyperlinks on the Website that allow access to other third-party websites over which AXIANS has no management control and assumes no responsibility.
When you choose to follow AXIANS on social media, your personal data may be processed by the respective managing entities in accordance with their privacy policies, which we recommend you read before browsing the websites.
F) Retention period of your Personal Data
Your Personal Data will be retained for the period of time necessary to carry out the purposes described in this Privacy Policy. In some exceptional cases, AXIANS may be required to retain your Personal Data for a longer period:
- To comply with legal obligations applicable to AXIANS;
- By way of contractual obligations assumed towards AXIANS or other companies of the Vinci Group, to which limitation periods may be added under the legislation in force;
- In the event of any dispute, whether administrative or judicial, up to 6 months after the respective sentence becomes final; or,
- Guidelines issued by competent data protection authorities.
G) How your Personal Data will be processed
During the period in which your Personal Data is retained, AXIANS guarantees that it is treated in accordance with this Privacy Policy.
For the security of your Personal Data, they will be processed in the context of the identified purposes, in accordance with the Vinci Group’s internal policy and rules, and using appropriate technical and organizational measures to promote their security and integrity, in particular in relation to unauthorized or unlawful processing and the respective accidental loss, destruction or damage of your Personal Data.
Without limitation, AXIANS uses logical and physical security requirements and measures to guarantee the protection of your Personal Data by preventing unauthorized access, ensuring that information is stored on secure computers in a closed and certified information center and that they are encrypted whenever possible, implementing audit and control procedures to ensure compliance with the Vinci Group’s security and privacy policies and periodically reviews our security policies and procedures to ensure that its systems are safe and protected.
However, because the transmission of information via the Internet is not completely secure, AXIANS cannot guarantee the security of your Personal Data when transmitted over an open network.
AXIANS does not sell, rent, distribute, or otherwise make available commercially or otherwise your Personal Data to any third party, except as identified in this Privacy Policy.
AXIANS preserves the confidentiality and integrity of your Personal Data and protects it in accordance with this Privacy Policy and all applicable laws.
H) International Transfers of Personal Data
AXIANS may transfer your Personal Data outside the European Economic Area (“EEA”) and to countries that may not guarantee the same level of protection equivalent to that ensured in the European Union.
In such cases, we may transmit your Personal Data for internal administrative purposes to the companies of the Vinci Group when they are party to the Intra-Group Agreement for the Protection of Personal Data (“IGA”), ensuring the international transfer of Personal Data in accordance with applicable legislation on personal data and privacy. The IGA parties are qualified as data controllers, or data controllers and processors, under applicable legislation.
We may also transfer your Personal Data based on an adequacy decision or standard data protection clauses approved by the European Commission – standard contractual clauses for Controllers (2004/915/EC) and standard contractual clauses for Processors (2010/87/EU).
When none of the above options apply, but the law still authorizes such transfer, for example, if it is necessary for the declaration, exercise or defense of a right in legal proceedings.

J) Privacy of “Minors”
The Website is intended for adults and not for children. With the exception of data provided by the parents or guardians of a Minor, AXIANS does not voluntarily collect Personal Data from Personal Data Subjects who are under the age of 18.
In the event that AXIANS discovers that it has inadvertently collected Personal Data from a minor under the age of 18, it will immediately delete the records containing the Minor’s information.

Right to information: You have the right to obtain clear, transparent, and easily understandable information about how AXIANS uses your Personal Data and what your rights are. It is because of this right that AXIANS makes this Privacy Policy available to you.
Right of access: You have the right to obtain information about what Personal Data AXIANS processes (if any) and certain information (similar to that provided in this Privacy Policy) about how your Personal Data is processed. This right allows you to confirm how we process your Personal Data in compliance with applicable law.
However, this right is not absolute, and AXIANS may refuse to provide the requested information whenever, in order to do so, it has to reveal Personal Data of another person/people or the information negatively impacts their rights.
